[private]John F. Harvey III, a lawyer with significant experience handling the tax aspects of fund formation, investment products and transactions, has joined international law firm Proskauer Rose LLP as a partner in the Boston office.

Mr. Harvey, who was formerly an associate at the firm, joins from Wellington Management Company, an asset manager to institutions around the world, where he was Director of Hedge Fund Tax.

At Proskauer, Mr. Harvey will be a partner in the Tax Department, where he will focus on a wide range of matters, including: the tax aspects related to the formation, operation and investment activities of a broad range of private investment funds, such as buyout, venture and hedge funds; the tax consequences of alternative investment products; and transactional matters such as cross-border deals and corporate restructurings.

In addition, Mr. Harvey will be a member of the Private Investment Funds Practice Group. The group, one of the world’s leading private equity and fund formation practices, has been expanding its capabilities over the past several years, both to new geographic regions such as Hong Kong, where the firm recently opened an office, as well as existing locations such as Paris and London, where partner Mary Kuusisto recently relocated to focus on expanding globally the firm’s practice relating to the structuring and operations of private investment funds.

According to Steven M. Ellis, head of Proskauer’s Boston office, Mr. Harvey’s experience and relationships in the industry will allow him to make an immediate impact on the firm’s widening global network.

“John’s unique and varied skill set will serve as an ideal strategic complement both here in Boston and across the firm,” he said. “Our private investment funds practice is extremely tax intensive and, as we expand our capabilities around the world, this experience becomes even more important. John is a key addition to what is already a tremendous platform.”

Robin A. Painter, co-head of Proskauer’s Private Investment Funds Practice Group, added: “I’ve worked with John both at Testa Hurwitz & Thibeault and here at Proskauer. He is a top-notch lawyer with a level of sophistication few can match. In addition to his strong roots in the issues our client base regularly encounters, John brings added expertise and depth in hedge fund matters and financial products. We are delighted that he has decided to join us.”

Proskauer’s Private Investment Funds Practice Group, which is recognized by Chambers USA, US Legal 500 and numerous other directories and publications as among the leading practices of its kind, represented sponsors in closing more than 125 funds with over $30 billion in committed capital and closed more than 450 investments in all types of funds, representing well over $19 billion, in 2008. The firm has also advised clients in numerous fund restructurings in the last year, negotiating and closing well over 100 secondary transactions with an aggregate value of more than $1 billion.
